Course content
Legal liability and laws
Our introduction to legal liability entails health and safety legislation, Occupational Health and Safety act no 85 of 1993 and Mine Health and Safety Act, no 29 of 1996. We also explain the difference between these two laws.
Employer liability
We introduce the learners to employer liability. We then go over a case study, followed by environmental damage high on list of executive liability, health and safety of persons. Common law, civil law and the employer’s general duty of care are then explained.
Facilitating legislation
We go over health and safety compliance and the requirements to ensure legal compliance in the workplace.
Safety management system
We go over the HSE plan, manual and management system. We take learners through conducting risk assessments, appointments, training and safety committee meetings. We then go over what must be done in the event of incidents. Workplace environmental issues are explained. Evaluating a safety management system, documentation and record keeping and closing the loop are explained in detail. The supervisor is identified and the importance thereof is gone over.
Duties of employers, workers and supervisors
The general duties of on-site personnel are explained in detail in relation to one another.
HSE management controls
This section will go over control programmes and procedures, followed then by the conclusion of theoretical training.
Practical application
We test the learners’ practical skills regarding legal liability.
Assessment methods
We conduct a formative theoretical assessment at the beginning of the course to gauge the learner’s initial understanding (novices only). At the end of the training, a summative theoretical and practical application assessment is conducted, to find if the learner is competent; if not, additional developmental areas are identified and suggested.
